Terms of Service (TOS) - BudaBestLife

Effective date: September 1, 2025

Entity: BudaBestLife (trading as “BudaBestLife”), registered in Hungary, (“BudaBestLife”, “we”, “us”, “our”).

Educational Purpose Only. BudaBestLife is a content and community platform intended for informational and educational use. We do not provide legal, financial, immigration, tax, or professional advice, and we make no guarantees of results from information, Listings, Requests, or services featured on the site.

1) Acceptance of These Terms

By accessing or using BudaBestLife.com (the “Site”) and any related services, tools, or features (collectively, the “Services”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization and that “you” refers to both you and that organization.
We may update these Terms from time to time. Material changes will be posted on the Site with a new effective date. Continued use constitutes acceptance.

2) Eligibility; Accounts

You must be at least 18 (or the age of majority in your jurisdiction) to create an account or post Listings/Requests.
Keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

3) Our Role; No Brokerage or Professional Services

BudaBestLife is not a broker, agent, insurer, escrow, payment intermediary, law firm, or professional advisory service.
Any relationships, transactions, or communications initiated via Listings or Requests occur solely between users. We do not vet, endorse, guarantee, or control user conduct, qualifications, pricing, availability, or outcomes.

4) User‑Generated Content (UGC): Listings & Requests

You may submit content, including Listings, Requests, text, images, profiles, links, and messages (“UGC”). You are legally and solely responsible for UGC you provide.

You agree that UGC must:

Be accurate, lawful, and not misleading.
Respect third‑party rights (IP, privacy, publicity, contract, trade secrets).
Comply with all applicable laws (consumer protection, advertising, immigration, housing, employment, financial services, etc.).

You agree that UGC must not:

Contain illegal, fraudulent, defamatory, hateful, harassing, pornographic, or otherwise harmful content.
Promote discrimination or violence; solicit unlawful activities; share others’ personal data without consent.
Include spam, malware, deceptive SEO, or attempts to manipulate rankings or ratings.
Offer controlled or prohibited goods/services or circumvent applicable licensing/permit requirements.

License you grant to us: You grant BudaBestLife a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, adapt, publish, display, and distribute your UGC for the operation and promotion of the Services (including reformatting and moderate edits that do not alter meaning).

Moderation & Takedown: We may, at our discretion and without notice or liability, refuse, remove, or restrict UGC; suspend or terminate accounts; and cooperate with authorities.

Notice & Action: To report illegal content or rights infringement, email support@budabestlife.com with: (a) link(s) to the content; (b) description of the issue; (c) your contact details; (d) a statement of good‑faith belief and accuracy; (e) proof of rights, if applicable. Repeat infringers’ accounts may be terminated.

DMCA (U.S. only): If you are a U.S. rights holder, you may send a DMCA‑style notice to support@budabestlife.com. Provide all elements required by 17 U.S.C. §512(c)(3). We may also accept counter‑notices.

5) Interactions, Payments & Third‑Party Services

Between users: Any negotiation, agreement, and transaction stemming from Listings/Requests is solely between users. Conduct appropriate due diligence, background checks, and obtain independent professional advice.
Payments: Unless expressly provided, BudaBestLife does not process or hold user funds. If you use a third‑party payment provider, you are subject to their terms and fees.
Third‑party links/tools: We are not responsible for third‑party sites/services. Use them at your own risk.

6) Acceptable Use

You agree not to:

Scrape, crawl, or use automated means except as permitted by robots.txt.
Reverse engineer, test, or bypass security or access controls.
Interfere with the Site’s normal operation, abuse reports/takedowns, or impersonate others.
Copy, frame, or mirror substantial parts of the Site without permission.

7) Intellectual Property

The Site, its content, and brand elements are owned by BudaBestLife or our licensors, protected by IP laws.
You may not use our logos, marks, or content except as permitted in writing.

8) No Warranties; Educational Use; No Outcome Guarantees

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied (including accuracy, fitness for a particular purpose, merchantability, non‑infringement, availability, and security).

We do not warrant that any information, Listing, Request, or service will meet your needs or produce desired outcomes.

9) Limitation of Liability

To the maximum extent permitted by law, BudaBestLife and its affiliates, officers, employees, and contributors will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, lost data, business interruption, or reputational harm arising from or related to your use of the Services, even if advised of the possibility. Our aggregate liability will not exceed EUR 100 (or the minimum permitted by law).

Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the fullest extent permitted.

10) Indemnification

You agree to defend, indemnify, and hold harmless BudaBestLife and its affiliates from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your UGC; (b) your use of the Services; (c) your breach of these Terms or laws; or (d) your dealings with other users.

11) Termination; Suspension

We may suspend or terminate your access at any time, with or without notice, for any reason. You may discontinue use at any time. Sections that by nature should survive termination will do so (e.g., licenses, disclaimers, limits of liability).

12) Governing Law; Disputes

These Terms are governed by the laws of Hungary, without regard to its conflict‑of‑law rules. Exclusive jurisdiction and venue lie in the courts of Budapest, Hungary. You agree to submit to personal jurisdiction there. If you are a consumer in the EEA, mandatory consumer protections in your country of residence also apply.

13) Miscellaneous

Entire agreement: These Terms + Privacy Policy are the entire agreement between you and us.
Severability: If any provision is unenforceable, the remainder remains in effect.
No waiver: Our failure to enforce a provision is not a waiver.
Assignment: You may not assign without our consent; we may assign to an affiliate or successor.
Language: We provide these Terms in English. If translated, the English version controls unless stated otherwise.
